Humble Police: Officer's Gun Accidentally Went Off

HUMBLE, Texas -- The wife of a car burglary suspect who was fatally shot by a police officer said that officer acted recklessly.

Humble police said an officer accidentally shot Estabon Carlon in the parking lot of Deerbrook Mall on Monday.

Detectives said Carlon and his brother were breaking into cars in the parking lot. The officer's gun went off when he broke out the passenger side window of a car the two were trying to get away in, investigators said. That car had been reported stolen, police said.

Carlon's wife said he called her cell phone shortly before the shooting and left a voice mail. She said she heard her husband's brother, Joaquin, screaming for help. She said the voice mail was about four minutes long.

"He (the officer) didn't even think about if he had family," said Jacquelin Garcia, Carlon's wife. "He didn't think about my two little girls. We had two little girls and one was on the way. That's just not right."

Quanell X, the family's spokesman, said the family wants a third party to investigate what happened.

"He went against a code of conduct for officer training in making this arrest, in using his gun to knock out a window of a suspect's vehicle," Quanell X said. "Use a nightstick or a baton, don't use a weapon because a weapon may discharge, and that's exactly what happened in this case."

Carlon's wife said if he hadn't gone to the mall, he would still be with her.

"He was in the wrong, but no one deserves to die like that, especially with a bullet to the head," Garcia said. "His family loved him. We all loved him."

Garcia said she did not know if Carlon had a criminal past.

The officer involved in the shooting has been with the Humble Police Department for 15 years. He has been placed on administrative leave.

Carlon's brother was arrested.
