Suspect Arrested, Charged in Incident at 908 Thompson

Charges have been filed against an armed suspect wounded by a Houston police officer at 908 Thompson about 3 a.m. on Sunday (Oct. 10).

The suspect, Jose Edgardo Rivera (H/m, DOB: 8-4-89), is charged with being a felon in possession of a weapon in the 232nd State District Court. Rivera suffered a gunshot wound to the shoulder and was treated and released from Ben Taub General Hospital. A photo of Rivera is attached to this news release.

Officer M.T. Hardt, who discharged his duty weapon, was not injured in this incident. Officer Hardt, assigned to the Central Patrol Division, was sworn in as an officer in July 2009.

HPD Homicide Division Sergeant R.A. Odom and Senior Police Officer L.K. Lovelace reported:

Officer Hardt responded to a shooting in-progress call near Washington Avenue and Thompson Street. When he arrived in the area, several citizens directed him to the suspect's (Rivera) location in the 900 block of Thompson. Upon seeing the officer, Rivera began walking away. Officer Hardt gave Rivera repeated commands for him to stop and show his hands. Ignoring the commands, Rivera continued walking until he entered a gate and into the yard of the residence at 908 Thompson. The officer continued to give Rivera commands for him to show his hands. After entering the yard, Rivera suddenly turned in the direction of the officer. Officer Hardt, in fear for his safety, discharged his duty weapon, striking the suspect. A large caliber pistol was recovered from the ground where the suspect fell after being shot. Rivera was then transported to the hospital.

As is customary in HPD officer-involved shootings within the city limits, this case will be investigated by the HPD Homicide and Internal Affairs Divisions and the Harris County District Attorney's Office.
