The following information taken from the Report of IAD Lieutenant J.R. Levingston, and/or Court documents (public records).

* A total of 59, 40 and 45 caliber shell casings were collected at the scene by Det. Huseman, HPD Homicide.

Note: Officers appealed their punishments to an Arbitrator - their punishments for violating HPD policies in this case were overturned. In other words, they received NO punishment for any violations of their own policies, or for the obvious execution of a unarmed citizen.

The IAD investigation found that nine officers and one dispatcher committed one or more violation of HPD policy during this incident. The areas of violations by each are summarized below:

1. Sgt. Antonio R. Guzman, age 40; Central Division

G.O. 600-34: High Risk Vehicle Approaches - Sgt. Guzman approached the vehicle while Kaeseman was still inside even though Guzman believed Kaeseman was possibly armed with a gun.

G.O. 600-8: Supervisory Conduct - Guzman did not actively enforce department policies on High Risk Vehicle Approaches during this incident. In fact, Guzman himself violated the policy on High Risk Vehicle Approaches.

* Gun used: 40 Caliber Mfg. Glock, Automatic

2. Officer Ruston K. Alsbrooks, age 38; Central Division

Ruston Alsbrook

G.O. 600-34: High Risk Vehicle Approaches - Officer Alsbrooks approached the vehicle while Kaeseman was still inside even though Alsbrooks believed Kaeseman was possibly armed with a gun.

3. Officer Scott William Wilkins, w/m, age 34; Westside Division (Partner with Officer Manuel)

G.O. 600-4: Motor Vehicle Pursuits - Wilkins was not authorized to engage in this chase.

G.O. 600-34: High Risk Vehicle Approaches - Officer Wilkins approached the vehicle while Kaeseman was still inside even though Wilkins believed Kaeseman was possible armed with a gun.

* Gun used: 40 Caliber Mfg. SIG Sauer, Semi-Automatic

4. Officer Marvin Jay Manuel, a/m, age 26; Central Division (Partner with Officer Wilkins)

G.O. 600-4: Motor Vehicle Pursuits - Manuel was not authorized to engage in this chase.

G.O. 600-34: High Risk Vehicle Approaches - Officer Manuel approached the vehicle while Kaeseman was still inside even though Alsbrooks believed Kaeseman was possibly armed with a gun.

G.O. 200-8: Conduct & Authority (Sound Judgment) - Manuel fired 12 rounds from a position of cover without stopping to assess the situation, placing Sgt. Guzman, Officers Alsbrooks, Harding and Wilkins and citizens in danger by unnecessarily placing them in the line of fire.

* Gun used: 40 Caliber Mfg. S&W, Semi-Automatic

5. Officer Tien "Tony" Ngoc Nguyen, age 29; Central Division

G.O. 600-4: Motor Vehicle Pursuits - Nguyen was not authorized to engage in this chase.

* Gun used: 45 Caliber Mfg. H&K USP, Semi-Automatic

6. Officer Leopoldo Benito Rubio Ronso, h/m, age 27; (former country of nationality: Venezuela) Central Division

G.O. 200-8: Conduct & Authority (Sound Judgment) - Rubio-Ronso fired 10 rounds from a position of cover without stopping to assess the situation, placing Sgt. Guzman, Officers Alsbrooks, Harding and Wilkins and citizens on the other side of the Freeway in danger by unnecessarily placing them in the line of fire.

* Gun used: 40 Caliber Mfg. S&W, Semi-Automatic

7. Officer Tony Tomeo, h/m, age 34; (former country of nationality: Uruguay) Central Division

G.O. 600-4: Motor Vehicle Pursuits - Tomero was not authorized to engage in this chase.

G.O. 600-34: High Risk Vehicle Approaches - Officer Tomero approached the vehicle while Kaeseman was still inside even though Wilkins believed Kaeseman was possibly armed with a gun.

G.O. 200-8: Conduct & Authority (Sound Judgment) - Tomeo fired 9 rounds from a position of cover without stopping to assess the situation, placing Sgt. Guzman, Officers Alsbrooks, Harding and Wilkins and citizens in danger by unnecessarily placing them in the line of fire.

Additional officers involved and their violations of HPD policy during this incident:

Officer Tolan Wade Harding, w/m, (former country of nationality: England) Central Division

G.O. 600-34: High Risk Vehicle Approaches - Officer Harding approached the vehicle while Kaeseman was still inside even though Harding believed Kaeseman was possibly armed with a gun.

Officer Miguel Angel Yanez, h/m, age 26, Westside Division

G.O. 200-8: Conduct & Authority (Sound Judgment) - Yanez used less sound judgment when he positioned his patrol vehicle directly in front of a fleeing vehicle with a possible armed suspect (Kaeseman) inside.

PCO Mayra Lucia Maldonado, h/f, age 25, Emergency Communications Division

G.O. 600-4: Motor Vehicle Pursuits - Maldonado failed to immediately designate a primary, secondary and supervisory unit to the chase as required by policy.
