A man shot by Houston police who believed he was grabbing for a gun has been charged with discharging a firearm, authorities said.

Thenhan Tran Huynh, 28, was struck once by police gunfire about 2:30 a.m. Sunday along the 5100 block of Westheimer. Huynh was treated at Ben Taub General Hospital for non life-threatening injuries, police said.

HPD officers M. Campbell and R. Gibson were finishing up an on-duty security job in the area when they heard gunfire. They spotted Huynh briefly holding a pistol out of the passenger-side window of a car, police said.

Campbell and Gibson approached the car and identified themselves as police. They opened fire when they saw Hyunh reach down, as if to grab for his pistol, authorities said.

The driver, Christopher S. Jones, 25, then fled at a high rate of speed. Their car was soon stopped by police along the 2700 block of Travis, officials said.

Huynh was treated and released into police custody. He remains in jail with bail set at $5,000. The driver was charged with felony evading arrest and released after posting $2,000 bail.

The shooting remains under investigation by Houston police and the Harris County District Attorney's Office.
