HOUSTON - Police say one man is in custody and another in the hospital after they were seen firing a weapon while driving on Westheimer in the Galleria area.

The incident happened around 2:30 a.m. Sunday.

Two Houston Police Department officers were in uniform, working an extra job at a night club when they saw a black car with two men inside. One of the men stuck his arm out the window and starting firing shots.

The officers jumped in a truck and followed the car. They say the men fired several more shots, some in the direction of the Galleria mall.

When the car came to a stop at a red light, one of the officers jumped out and ordered the suspect to drop the weapon. The suspect refused, and raised it up again. That's when the officer shot the suspect in the neck.

The black car took off, but they were located again a short time later in the 2700 block of Travis.

The male suspect who was shot was transported to Ben Taub in stable condition. The other man, the driver of the car, was arrested.

It was not known why the men were firing shots from the moving car.

Neither officer was hurt.
